# Copy-Paste Treatment Plans Just Got a Federal Side-Eye

**Before the tea:** This is a recap of reporting by Behavioral Health Business (Oct 19, 2026) on a CMS toolkit. It is not legal, billing, or clinical advice. Check your state Medicaid guidance and the source.

Picture this: You're reviewing a treatment plan for a new client, but something looks familiar. Same goals, same recommended hours, and a plan that looks suspiciously similar to the last client's.

Well, CMS is paying attention. In August, the agency released a 173-page ABA Toolkit to help state Medicaid programs evaluate ABA services. It's guidance, not a new federal rule, so states can decide how to use it.

But here's where things get interesting: As highlighted by Behavioral Health Business, standardized treatment plans that consistently recommend high numbers of therapy hours—without clear, individualized clinical justification—could raise concerns about potential fraud.

The message from CMS? More hours shouldn't automatically be the answer. If a child needs intensive ABA services, their treatment plan should clearly explain why, based on their individual needs and goals.

And payers are paying attention. One industry advisor told Behavioral Health Business (BHB) that insurers are already taking a closer look at treatment plans recommending more than 30–35 hours per week.

**The goal isn't fewer hours. It's the right hours for the right client.**

Follow the money. According to BHB, ABA spending grew from $1.94 billion in 2021 to $10.1 billion in 2025.

So bring this question to your next interview: who actually sets the hours? If your name is on the plan, the reasoning should be yours too.

**Pair's Take**

Our matchmakers ask clinics this exact thing. The ones that let BCBAs make the clinical call are already living in the toolkit's world.
